Florida Tax Deed Surplus Funds

When a Florida tax deed sale produces more than the amounts required by the sale, the remaining proceeds may be held for people with a qualifying interest.

The basic idea

Why surplus funds can remain

A tax deed sale is used to address delinquent property taxes. If the property sells for more than the applicable opening bid, taxes, costs, and other required amounts, an excess balance may remain.

Florida law directs the county clerk to handle and distribute those proceeds according to the applicable priorities and claim process. The existence of a sale does not automatically mean funds remain, and the existence of surplus does not automatically establish who will receive it.

Who may need to review the record?

  • The former legal titleholder
  • An heir or family member when the former owner is deceased
  • An estate or personal representative
  • A person or entity with a recorded interest
  • A lienholder or governmental unit

Priority can depend on the public record and applicable law.
